Domain Registration Agreement

This agreement outlines the terms and conditions for domain registration services provided through Bubblehost, and your obligations as a domain name registrant. It applies in addition to our Terms of Service and Privacy Policy. If there is any inconsistency between this agreement and our Terms of Service in relation to domain names, this agreement applies.

1. Scope and Definitions

Bubblehost registers, renews and transfers domain names on your behalf through accredited domain registrars and registries. By registering, renewing or transferring a domain name through us, you agree to this agreement, as well as the policies of the relevant registrar and registry.

• “Bubblehost”, “we”, “us” and “our” refer to Bubblehost, Unit 1, 32 Roberts Street, Moora WA 6510, Australia.
• “You”, “your” and “Registrant” refer to the person or organisation in whose name a domain is registered.
• “Domain” means a domain name registered, renewed or transferred through Bubblehost.
• “Registry” means the organisation that manages a domain extension, such as auDA for .au domains or Verisign for .com and .net.
• “Registrar” means the accredited organisation that registers domains with the Registry on our behalf.
• “ICANN” means the Internet Corporation for Assigned Names and Numbers, which oversees generic domain extensions such as .com, .net and .org.
• “auDA” means .au Domain Administration Ltd, which oversees the .au domain space.
• “Registration Period” means the length of time you have paid to register or renew a Domain.

2. Registration Obligations

By registering a Domain through our services, you agree to provide accurate, complete and current information. This includes the registrant, administrative, technical and billing contact details for the Domain.

You are responsible for:

• Ensuring the accuracy of this information at all times, and updating it promptly through the Client Area if anything changes
• Responding to any verification emails from us, the Registrar or the Registry. For many domain extensions, the registrant’s email address must be verified within 15 days of registration or a contact change, or the Domain may be suspended
• Making sure the Domain name, and the way you use it, does not infringe anyone else’s trademark or other legal rights

Providing false, inaccurate or out-of-date information, or failing to respond to a verification request, is a breach of this agreement and may result in your Domain being suspended or cancelled.

Where you register a Domain on behalf of someone else, such as a client, you confirm that you have their permission, and that you will tell them about this agreement. The person or organisation listed as the registrant is treated as the holder of the Domain.

3. Eligibility for .au Domains

Domains ending in .au, including .com.au, .net.au, .org.au and .au, are subject to the eligibility and allocation rules set by auDA. To register or renew a .au Domain, you must have an Australian presence. Depending on the extension, this may mean:

• An Australian Business Number (ABN), Australian Company Number (ACN) or registered business name
• Being an Australian citizen or permanent resident
• Holding an Australian trademark that matches the Domain name
• Being an eligible not-for-profit organisation (for .org.au)

You are responsible for making sure you meet and continue to meet these rules for as long as you hold the Domain. auDA may audit registrations at any time, and a Domain may be cancelled if eligibility cannot be shown. Other domain extensions may have their own eligibility rules, which will be shown when you order.

4. Nature of Domain Registration

When you register a Domain through our services, you become the registrant of that Domain. Registering a domain gives you the right to use it for the Registration Period, rather than permanent ownership. For .au Domains, this right is a licence granted under auDA’s rules. For other extensions, it is held under the rules of the relevant Registry and ICANN.

Provided you follow this agreement and the applicable rules and laws, you have the right to use, renew, update and transfer the Domain. You keep control of the Domain regardless of whether you also host your website with Bubblehost. Bubblehost does not claim any rights to your Domain.

Domain registrations are processed on a first-come, first-served basis. A Domain is not registered until the Registry has confirmed it, and we cannot guarantee that a Domain shown as available will be successfully registered. If a registration fails, we will refund the fee paid for it.

5. Fees and Payment

• Domain fees are shown on our website and must be paid in full before a Domain is registered, renewed or transferred.
• All prices are in Australian dollars (AUD) unless stated otherwise.
• Domain fees are paid to Registries and Registrars as soon as an order is processed. For this reason, domain registrations, renewals and transfers are non-refundable once processed, and are not covered by our 30-day money-back guarantee, except where required by law.
• Where a free Domain is included with a hosting plan, it is free for the first Registration Period only, while the hosting plan remains active and paid. If the hosting plan is cancelled within the first Registration Period, we may charge the standard registration fee for the Domain, or you may choose to let it lapse.
• Registry fees can change. We may update our domain prices from time to time, and the new price will apply to your next renewal.
• Some premium domain names carry higher registration and renewal fees set by the Registry. These will be shown before you order.

6. Renewals and Expiry

You are responsible for renewing your Domain before it expires. We will send renewal reminders to the email address on your account before the expiry date, but failing to receive a reminder does not remove your responsibility to renew.

• If automatic renewal is turned on and a valid payment method is saved, we will attempt to renew your Domain before it expires.
• If a Domain is not renewed by its expiry date, it may stop working, including any website and email that use it.
• Many Registries offer a short grace or redemption period after expiry, during which the Domain may still be recovered. The length of this period and any redemption fee depend on the Registry, and a redemption fee may be significantly higher than a normal renewal.
• Once any grace or redemption period ends, the Domain may be deleted and become available for anyone to register. We cannot guarantee that an expired Domain can be recovered.

Failure to renew in a timely manner may result in the permanent loss of the Domain. Bubblehost is not responsible for any loss caused by a Domain expiring.

7. Transfers

7.1 Transferring a Domain to Bubblehost

To transfer a Domain to us, you will need the transfer authorisation code (also called an EPP or auth code) from your current provider, and the Domain must be unlocked. A transfer may take several days to complete. For many extensions, a transfer also adds one year to the registration period, and the transfer fee covers this.

7.2 Transferring a Domain Away from Bubblehost

You may transfer your Domain to another provider at any time, subject to the rules of the Registry. We will provide your transfer code on request through the Client Area or support, as long as:

• You are the registrant, or authorised by the registrant
• There are no unpaid invoices for the Domain
• The Domain is not subject to a dispute, legal order or suspension for breach of this agreement

We do not charge a fee to transfer a Domain away. Some extensions, including many generic ones such as .com, cannot be transferred within 60 days of registration, a previous transfer or a change of registrant details. The new provider may also charge its own transfer fee.

7.3 Change of Registrant

Changing the registrant (the legal holder) of a Domain may be subject to Registry rules, including eligibility checks for .au Domains and a temporary transfer lock for some other extensions.

8. WHOIS and Privacy

Registries and Registrars require us to collect registrant and contact details for every Domain, and to pass these details on to them. Some of this information may be published in public WHOIS or registry lookup services, depending on the rules of the domain extension:

• Generic domains (such as .com, .net and .org): most personal contact details are now hidden from public WHOIS, although the registrant’s organisation, state and country may still be shown.
• .au domains: public lookups show the registrant name and eligibility details, but not your personal email, phone number or address.

Where available, you can choose to use a privacy protection service to hide more of your details. Even with privacy protection, your full details are still held by us, the Registrar and the Registry, and may be disclosed where required by law, by Registry or ICANN policy, or in response to a valid complaint such as a trademark dispute.

We handle your personal information in line with our Privacy Policy.

9. Registry Policies and Dispute Resolution

Your Domain is subject to the policies of the relevant Registry, Registrar and governing body, which may change from time to time. You agree to follow these policies, including:

• For generic domains: ICANN policies, including the Uniform Domain-Name Dispute-Resolution Policy (UDRP)
• For .au domains: auDA’s policies and licensing rules, including the .au Dispute Resolution Policy (auDRP)

Disputes about who has the right to a Domain, such as trademark claims, are resolved through these dispute resolution processes and applicable law, not by Bubblehost. You agree to take part in any such process if a complaint is made about your Domain. We will follow any decision from a dispute resolution provider, court or Registry, which may include transferring, suspending or cancelling your Domain.

10. Prohibited Use

You must not register or use a Domain:

• In a way that infringes someone else’s trademark, business name or other rights, including registering a Domain in bad faith to sell it to the rightful owner (cybersquatting)
• For phishing, fraud, scams, spam, malware distribution or other illegal activity
• To host or link to content that is illegal in Australia or harmful to others
• To impersonate any person, business or government body
• In breach of our Terms of Service, Acceptable Use Policy or any Registry policy

11. Suspension, Cancellation and Termination

We, the Registrar or the Registry may suspend, lock, cancel or transfer a Domain if:

• You breach this agreement or the rules of the Registry
• Your registrant information is false or inaccurate, or you fail to respond to a verification request
• You no longer meet the eligibility rules for the Domain
• The Domain is used for abuse, fraud or illegal activity
• We are required to do so by a court order, law enforcement, dispute resolution decision or Registry instruction
• A payment for the Domain is reversed, disputed or not made

Where it is practical and lawful, we will contact you first and give you a chance to fix the problem. In serious cases, such as phishing or malware, we may act immediately. Suspension or cancellation may result in the loss of the Domain, and fees will not be refunded.

We reserve the right to take necessary actions to protect our services, our customers and the wider internet community.

If your hosting account with us is cancelled, your Domain does not automatically end. It will remain registered to you until its expiry date, and you may renew it, transfer it or let it lapse.

12. Limitation of Liability

Nothing in this agreement excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

Subject to that, and to the maximum extent permitted by law, Bubblehost is not liable for any loss or damage arising from:

• A Domain expiring, being deleted or being registered by someone else
• Delays, errors or outages caused by a Registry, Registrar or other third party
• Suspension, cancellation or transfer of a Domain under Registry policies, a dispute resolution decision or a court order
• Inaccurate information you provide
• Any indirect or consequential loss, including loss of profits, revenue, business or data

Otherwise, our total liability for any claim relating to a Domain is limited to the fees you paid us for that Domain in the 12 months before the claim arose.

13. Changes to This Agreement

We may update this Domain Registration Agreement to reflect changes in our practices, or in Registry, auDA or ICANN policies, or for legal, operational or regulatory reasons. Updates will be posted on this page and the “Last updated” date will be changed. We may not always give prior notice of changes, so it is your responsibility to review this agreement periodically to ensure you stay compliant. Your continued use of our domain services after an update means you accept the revised agreement.

14. Governing Law

This agreement is governed by the laws of Western Australia, Australia, and the parties submit to the non-exclusive jurisdiction of its courts. This does not affect any Registry or ICANN dispute resolution process that applies to your Domain.
