These Terms of Service set out the agreement between you and Bubblehost for the use of our website, client area and all of our hosting, domain and related services. Please read them carefully, together with our Privacy Policy, Acceptable Use Policy, Refund and Returns Policy and Domain Registration Agreement, which form part of these terms.

1. Acceptance of Terms

By accessing or using our website hosting services, you agree to comply with and be bound by these Terms of Service. Your use of the Services constitutes your acceptance of these terms. If you do not agree with any part of these terms, you should not use the Services.

By creating an account or placing an order, you confirm that:

  • You are at least 18 years old, or you have permission from a parent or guardian to use our Services
  • The information you provide to us is accurate, complete and up to date
  • If you are accepting these terms on behalf of a business or organisation, you have the authority to bind that business or organisation to them

2. Definitions

  • “Bubblehost”, “we”, “us” and “our” refer to Bubblehost, Unit 1, 32 Roberts Street, Moora WA 6510, Australia.
  • “You” and “your” refer to the person or organisation that holds an account with us or uses our Services.
  • “Services” means all services we provide, including shared hosting, WordPress hosting, reseller hosting, VPS hosting, domain registration, email, backups, migrations and technical support.
  • “Account” means your customer account with Bubblehost.
  • “Client Area” means our secure customer portal at bubblehost.com.au/client.
  • “Content” means any websites, files, data, databases, emails, text, images, software or other material you or your users store on or send through our Services.
  • “Billing Cycle” means the period you pay for in advance, such as monthly, quarterly or annually.

3. Service Description

We provide website hosting services that allow you to publish and manage your websites on our servers. Our hosting Services include server space, bandwidth, email, a control panel and technical support, so that your website is accessible and functional for visitors around the world. The exact features and resource limits of each plan are shown on our website at the time you order.

3.1 Managed Hosting

Our hosting plans include management as standard. This means our team looks after the setup, maintenance, security and general upkeep of our servers and platform, and we will help troubleshoot problems with your website as part of our support. Management does not include custom development, design work, or writing or rewriting code for your website, unless we agree to it separately.

3.2 Uptime and Maintenance

We aim to keep our Services available with 99.9% uptime. We strive to maintain the highest level of service quality, but occasional scheduled maintenance and unforeseen issues may arise. Where possible, we will give notice of planned maintenance that may affect your Services. Downtime caused by scheduled maintenance, your own actions or Content, third-party providers, or events outside our reasonable control is not counted against our uptime target.

3.3 Changes to Services

We may improve, change or replace parts of our Services, software or infrastructure from time to time. If a change would significantly reduce the features or resources of a plan you have already paid for, we will let you know beforehand.

4. Accounts

To use our Services, you need to create an Account and provide accurate, complete and current information. You must keep your details up to date, including your email address, as we use it to send important notices about your Services and billing.

You are responsible for keeping your login details secure and for all activity that happens under your Account. You must not share your Account with others outside your business or organisation. If you believe your Account has been accessed without permission, you must tell us immediately.

We may ask you to verify your identity or payment details, and we may refuse or cancel an order if we are unable to verify them or reasonably suspect fraud.

5. User Responsibilities and Acceptable Use

You are responsible for the Content you upload, your website’s security, and complying with all applicable laws and regulations. You must not use our Services for any illegal or malicious activities. This includes, but is not limited to:

  • Distributing malware, viruses, ransomware or other harmful software
  • Hacking, attempting to gain unauthorised access to any system, or scanning networks for vulnerabilities without permission
  • Phishing, fraud, scams or impersonating any person or organisation
  • Sending spam or unsolicited bulk email, or breaching the Spam Act 2003 (Cth)
  • Infringing copyright, trademarks or other intellectual property rights, including hosting pirated software, films, music or other content
  • Hosting or distributing child sexual abuse material or any other content that is illegal in Australia
  • Hosting content that promotes violence, terrorism or hatred against people
  • Running cryptocurrency mining, open proxies, IRC bots, or denial-of-service tools
  • Anything that could harm our servers, network, other customers or our reputation

You are also responsible for:

  • Keeping the software you install, such as WordPress, themes and plugins, reasonably up to date
  • Using strong passwords for your Account, control panel, websites and email accounts
  • Keeping your own copies of important website data, as described in Section 10
  • Ensuring any personal information your website collects is handled in line with the privacy laws that apply to you

We may remove or disable access to any Content that breaches these terms, or that we are required to remove by law. Where it is practical and lawful, we will tell you before doing so.

6. Fair Use of Resources

Our shared, WordPress and reseller hosting plans run on servers shared with other customers. To keep performance fair for everyone, each plan has resource limits for disk space, bandwidth, CPU, memory, email and databases, as shown on our website.

Where a plan is described as “unlimited”, this means we do not set a fixed limit for normal website use. It is still subject to fair use and must not be used for file storage, backups of other systems, media streaming, file sharing or anything that places an unreasonable load on our servers.

If your account uses more than its fair share of resources and affects other customers, we will contact you to discuss options such as optimising your website or upgrading your plan. In urgent cases, such as a sudden spike threatening server stability, we may temporarily limit or suspend your account to protect other customers, and we will let you know as soon as possible.

7. Payment and Billing

You agree to pay the fees for the plan and Services you choose. Prices, Billing Cycles and accepted payment methods are shown on our website and in the Client Area. All prices are in Australian dollars (AUD) unless stated otherwise.

  • Payment in advance: Services are billed in advance for each Billing Cycle.
  • Automatic renewal: Subscription-based plans renew automatically at the end of each Billing Cycle unless you cancel before the renewal date. If you have a saved payment method, it will be charged automatically on renewal.
  • Invoices: We send invoices before the due date to the email address on your Account.
  • Late payment: If payment is not received by the due date, we will send reminders. Failure to make timely payments may result in suspension of your Services. If an invoice remains unpaid, your Services may be terminated and your Content deleted.
  • Price changes: We may change our prices from time to time. We will give you at least 14 days’ notice before a price increase applies to your existing Services, and the new price will apply from your next Billing Cycle.
  • Chargebacks: If you dispute a payment with your bank or card provider without first contacting us, we may suspend your Services while the dispute is resolved.

8. Refunds and Money-Back Guarantee

We offer a 30-day money-back guarantee on new hosting Services. If you are not happy within the first 30 days of your first hosting order, you can cancel and request a full refund of the hosting fees paid.

The money-back guarantee does not cover:

  • Domain registrations, renewals and transfers, as these are paid to domain registries and usually cannot be reversed
  • Renewals of existing Services
  • Accounts that are suspended or terminated for breaching these terms
  • Add-on services, setup fees or third-party licences, unless stated otherwise

Outside of the 30-day guarantee, we do not provide refunds for unused portions of a Billing Cycle, except where required by law. You can cancel at any time through the Client Area, and your Services will remain active until the end of the Billing Cycle you have paid for.

Nothing in this section limits any rights you have under the Australian Consumer Law. Full details are in our Refund and Returns Policy.

9. Domain Names

Domain registrations are also governed by our Domain Registration Agreement and the rules of the relevant domain registry, such as auDA for .au domains.

  • You must provide accurate registrant details, and you are responsible for meeting any eligibility rules (for example, .com.au domains require an Australian presence, such as an ABN or ACN).
  • Domains are registered for the period you pay for and must be renewed before they expire. We will send renewal reminders, but it is your responsibility to renew on time. Expired domains may be lost and may be expensive or impossible to recover.
  • You can transfer your domain away from Bubblehost at any time, subject to registry rules. We will provide your transfer (EPP) code on request, provided your account is not in breach of these terms and no payments are outstanding.
  • Where a free domain is included with a hosting plan, it is free for the first registration period only while the plan remains active. After that, the standard renewal price applies.

10. Backups

We perform regular automated backups of our hosting servers to help protect against data loss. However, backups are provided as a courtesy and as part of our disaster recovery process, and we cannot guarantee that every backup will be complete, current or restorable.

You are responsible for keeping your own up-to-date copies of your website files, databases and emails. We strongly recommend downloading a backup regularly and before making any major changes to your website.

11. Support and Management

Our support team is available through support tickets, email, live chat and phone, as listed on our website. We will make reasonable efforts to respond promptly and resolve issues, but response times may vary depending on the time of day and the complexity of the issue.

As part of our managed hosting, support includes help with account setup, migrations, server issues, email configuration, and troubleshooting common problems with your website. Support does not include:

  • Custom development, design changes or writing code for your website
  • Fixing problems caused by third-party themes, plugins or software beyond reasonable troubleshooting
  • Training on how to use third-party software
  • Services not hosted with Bubblehost

We may offer these as paid services, and we will always confirm the cost with you before starting any paid work.

12. Reseller Hosting

If you use our reseller hosting, you may resell hosting to your own customers under your own brand. You are responsible for:

  • Your customers’ accounts, billing, support and compliance with these terms
  • Having your own terms of service and privacy policy for your customers that are at least as protective as these terms
  • Any breach of these terms by your customers, as if it were your own

We provide support to you as the reseller, and we do not provide direct support to your customers. If one of your customers breaches these terms, we may suspend that customer’s account and will let you know.

13. Suspension and Termination

13.1 Cancellation by You

You can cancel your Services at any time through the Client Area. Cancellations take effect at the end of your current Billing Cycle, unless you request immediate cancellation. Before cancelling, you should download a copy of any Content you want to keep, as it will be deleted once your Services end.

13.2 Suspension or Termination by Us

We reserve the right to suspend or terminate your Services if:

  • You breach these terms or our Acceptable Use Policy
  • Your invoices remain unpaid after the due date
  • Your account or Content poses a security risk to our servers, network or other customers
  • We are required to do so by law, a court order or a government authority
  • We reasonably suspect fraud or abuse

Where practical, we will contact you first and give you a reasonable opportunity to fix the problem. In serious cases, such as illegal content, malware or an active attack, we may suspend your Services immediately without notice.

If your account is terminated due to a breach of these terms, you may lose access to your website Content and data, and you will not be entitled to a refund. We may also take legal action if your actions cause harm to our servers, network, customers or reputation.

13.3 After Termination

After your Services end, we may keep your Content for a short period in case you change your mind, after which it will be permanently deleted. We are not required to keep or provide a copy of your Content after termination.

14. Content and Intellectual Property

You keep ownership of all Content you upload to our Services. You give us permission to store, copy and transmit your Content only as needed to provide the Services, perform backups and migrations, and comply with the law.

You confirm that you own or have the right to use all Content you host with us, and that it does not infringe anyone else’s rights.

The Bubblehost name, logo, website design, graphics and software belong to Bubblehost or our licensors. You may not copy or use them without our written permission.

If you believe Content hosted on our Services infringes your copyright or other rights, please contact us with details and we will investigate.

15. Privacy

We collect and handle your personal information in line with our Privacy Policy, which explains what we collect, how we use it and your rights. By using our Services, you acknowledge our Privacy Policy.

16. Limitation of Liability

16.1 Australian Consumer Law

Our Services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

16.2 Our Liability

To the maximum extent permitted by law, and subject to Section 16.1:

  • We are not liable for any indirect, incidental, special, consequential or punitive loss or damage, including loss of profits, revenue, data, business or goodwill, arising from the use or inability to use our Services
  • We are not liable for any loss caused by your Content, third-party software, your own actions, other customers, or events outside our reasonable control, such as natural disasters, power or internet outages, or cyber attacks
  • Where our liability for a failure to meet a consumer guarantee can be limited, it is limited, at our option, to supplying the Services again or paying the cost of having them supplied again
  • Otherwise, our total liability to you for any claim is limited to the amount you paid us for the affected Services in the 3 months before the claim arose

While we strive to provide reliable and secure hosting, no online service is completely immune to outages or vulnerabilities. You acknowledge this when you use our Services.

17. Indemnity

To the extent permitted by law, you agree to indemnify Bubblehost against any loss, damage, cost or claim (including reasonable legal costs) arising from:

  • Your breach of these terms
  • Your Content, or your customers’ Content if you are a reseller
  • Your breach of any law or the rights of any third party

This does not apply to the extent the loss was caused by our own negligence or breach of these terms.

18. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes to our Services, business, or legal and regulatory requirements. Updates will be posted on this page and the “Last updated” date will be changed. We may not always give prior notice of changes, so it is your responsibility to review these terms periodically to stay informed about anything that may affect your use of our Services. Your continued use of our Services after an update constitutes your acceptance of the updated terms.

19. Governing Law

These terms are governed by the laws of Western Australia, Australia. You and Bubblehost agree to submit to the non-exclusive jurisdiction of the courts of Western Australia. Before starting any legal proceedings, we both agree to first try to resolve any dispute informally by contacting each other.

If any part of these terms is found to be invalid or unenforceable, the rest of the terms will continue to apply. If we do not enforce a right under these terms straight away, we have not given up that right.
